Georgia Will Let a Jury Divide Your House, and Will Tax the Loan You Use to Keep It

We are a lender, not a law firm. Georgia does two things to a divorce buyout that most states do not, and one of them costs real money at closing.

★★★ A Georgia jury can dispose of the property

O.C.G.A. § 19-5-13 is one sentence, and it is remarkable:

"The verdict of the jury disposing of the property in a divorce case shall be carried into effect by the court by entering such judgment or decree or taking such other steps as are usual in the exercise of the court's equitable powers to execute effectually and fully the jury's verdict."

★★★ Georgia is one of very few states where a jury can decide how property is divided in a divorce. O.C.G.A. § 19-5-1 sets the switch: the judge decides "unless an issuable defense is filed… and a jury trial is demanded in writing by either party on or before the call of the case for trial."

★★ For a buyout that matters in a concrete way: the figure a lender eventually underwrites may come out of a verdict, not only out of a judge's order or a negotiated agreement. What that changes, and what we will not advise on.

★★★ And the Georgia code does not tell you how it splits

★★★ California's Family Code says "equally" in one sentence. Texas's says "just and right" in one sentence. We did not find an equivalent Georgia code section stating the standard at all. Georgia's equitable-division doctrine lives in case law, which we did not read and will not paraphrase. Why we say that rather than guessing.

★★★ Georgia taxes the note, not just the deed

This is the one that costs money, and most people planning a buyout have never heard of it.

★★★ A buyout refinance creates a new note: and Georgia taxes notes at $1.50 per $500 of face amount, which is 0.30%. That is three times the rate of the tax on the deed, and it is charged on the loan amount, which in a buyout is usually larger than the equity being transferred. The rate, the cap, and who can pass it on.

★ The deed tax is smaller and, per the Department of Revenue, "the seller is liable… though frequently the parties agree in the sales contract that the buyer will pay the tax." Liability against allocation.

★★ A small exemption off a 40% assessment

Georgia assesses at 40% of value, and the statewide standard homestead exemption is $2,000 deducted from that assessed figure. Next to Texas's $140,000 school-district exemption, Georgia's statewide relief is small. The real relief here is local.

★★★ And one local feature matters enormously in a divorce: several Georgia counties freeze valuation at the base year "for as long as the homeowner resides on the property." Whether that freeze survives a divorce, when one spouse leaves and title moves, is not something we read at a primary source, and it could be worth a great deal. Ask your county, and here is why.

★★ Georgia rose. Atlanta did not.

32 of Georgia's 37 metros gained over the year to August 2026. ★★★ Atlanta was one of the five that fell, down 1.6%, and Savannah fell furthest at -2.6%.

★★ So "the Georgia market is up" is true and useless to an Atlanta client, where most Georgia divorces happen. Every metro, and what a soft appraisal does to a settlement.

Yes. O.C.G.A. section 19-5-1(a) provides that the judge hears and determines all issues unless an issuable defense is filed and a jury trial is demanded in writing by either party on or before the call of the case for trial, and section 19-5-13 refers to the verdict of the jury disposing of the property in a divorce case, carried into effect by the court in the exercise of its equitable powers.

Does Georgia split property 50/50 in a divorce?

Georgia is an equitable-distribution state, not a community-property state, and its code does not state a division formula. California's Family Code section 2550 requires an equal division and Texas's section 7.001 requires a division that is just and right, but no equivalent Georgia code section states the standard; the doctrine is developed in case law.

What is the Georgia intangible recording tax?

A tax on the mortgage note rather than the deed, charged at $1.50 for each $500 or fractional part of the face amount of the note, which is 0.30 percent, with a maximum of $25,000 on any single note. Because a divorce buyout refinance creates a new note, it applies to the loan amount.
