A Small Statewide Exemption, and a Local Freeze Worth Asking About

Georgia's statewide relief is modest. The part that can be worth a great deal is local, and it contains a divorce question nobody seems to answer.

★★ The statewide figures

From the Georgia Department of Revenue, Property Tax Homestead Exemptions:

"The home of each resident of Georgia that is actually occupied and used as the primary residence by the owner may be granted a $2,000 exemption from county and school taxes… The $2,000 is deducted from the 40% assessed value of the homestead." (O.C.G.A. § 48-5-44)

★★★ Two things there. The exemption is $2,000, and it comes off the 40% assessed value: Georgia assesses property at 40 percent of value, so this is a deduction from the assessed figure rather than from market value.

★★ For scale: Texas's school-district homestead exemption is $140,000. Georgia's statewide standard exemption is $2,000. ★ The Department says as much itself, many counties have increased their exemptions by local legislation above the state amounts, and "as a general rule the exemptions offered by the county are more beneficial to the homeowner."

★ The other statewide exemptions

  • Individuals 65 and over may claim a $4,000 exemption, on conditions.
  • A floating inflation-proof county exemption for those 62 and over, where income with a spouse or others in the house does not exceed $30,000 (O.C.G.A. § 48-5-52).
  • ★ A disability-related exemption with a 2025 maximum benefit of $96,432, which may not exceed $10,000 of assessed value.

★★★ The local base-year freeze, and the divorce question

This is the part worth real money, and the Department names the counties that have it:

"Several counties have implemented an exemption that will freeze the valuation of property at the base year valuation for as long as the homeowner resides on the property. Even as property values continue to rise, the homeowner's taxes will be based on the base year valuation."

★★★ Now read that against a divorce. One spouse leaves. The other stays. Title moves between them. A new deed is recorded.

★★★ Does the freeze survive? Does it survive for the spouse who remains in residence? Does a transfer between spouses reset the base year?

★★★ We do not know, and we did not read it at a primary source, so we are not going to tell you. What we will tell you is that in a county with a long-standing freeze on a home that has appreciated for years, the answer could be worth a great deal every year for as long as you own the house, which makes it one of the highest-value questions on this entire site.

★★ Ask your county tax commissioner, and ask before the transfer, not after. If the answer is bad, it is far better known while the structure is still being decided.

★★ Why a lender raises it

Because property tax is escrowed into the monthly payment we underwrite, and the payment is what a single income has to carry after the divorce.

★★ A frozen base-year valuation that survives produces a materially lower escrow than one that resets. ★ So send us the actual current tax bill, tell us whether a freeze is in place, and tell us what your county says about the transfer. Where that sits in the whole picture.
