We pulled the metro file ourselves. The statewide number is good and the number that applies to most Georgia divorces is not.

★★★ Thirty-two up, five down — and which five

Georgia had a good year by the headline count: 32 of 37 metros rose.

★★★ The five that fell were Savannah (-2.6%), Fitzgerald (-2.4%), Atlanta (-1.6%), Gainesville (-1.3%) and Jefferson (-0.3%).

★★★ Atlanta is on that list: and the Atlanta metro is where the overwhelming majority of Georgia divorces happen. So "the Georgia market rose" is accurate, cheerful, and of no use whatever to someone dividing a house inside the perimeter.

★★ It is a near-mirror of what we found in Texas, where all four big metros fell, except that Texas was 38 up / 29 down statewide and Georgia is 32 up / 5 down. ★ Same lesson, opposite backdrop: the state average is not your market.

★★★ What a soft Atlanta does to a settlement

In a buyout the equity being divided is set by a valuation, and the lender's valuation is an appraisal ordered when the loan is in process, often months after the figure was agreed.

★★★ In a metro that fell 1.6%, an agreed figure from several months ago can meet an appraisal that no longer supports it, after signature, with a loan in underwriting, and both people wanting to be finished.

★★ The drafting consequence: a stated sum behaves differently from a method. A stated sum is certain and can become unaffordable. A method tied to an appraisal moves with the market and can unsettle someone who thought the number was final.

★★★ We take no position on which to use. That is a legal and negotiating decision. We raise it because it has a financing consequence and should be chosen deliberately. The short version for counsel.

★★ And the Georgia costs do not fall with the market

Two of them scale with the transaction, not with your equity:

  • ★★★ The intangible recording tax at 0.30% of the face amount of the note: and the note size is driven by what you must pay out, not by what the house appraises at. The detail

★★ So in a softening Atlanta a buyout can cost the same to execute while delivering less equity than assumed. That is worth modelling before the number is fixed, not after.
